The European Union Artificial Intelligence Act (Regulation (EU) 2024/1689), coming into force on 1 August 2024, has carved a niche as the first holistic legislation covering the realm of AI the landmark in AI law worldwide.   • Unacceptable Risk: AI systems that represent high risks, e.g., systems that facilitate social scoring or insidious subliminal methods, are explicitly prohibited, as of February 2, 2025. They have little direct application to education yet establish a precedent in using ethic AI.

  • High-Risk: Systems that have a significant impact on safety or other fundamental rights, such as systems in education and vocational training, are exposed to rigid requirements. These are the risk evaluation, human supervision, transparency, and registration in an EU database by August 2, 2027.

  • Restricted Risk: AI tools such as chatbots or deepfake generation engines are amenable to examples of transparency conditions, including via publicity of AI-authored material, as of August 2, 2025.

  • Minimal Risk: Spam filters and other systems have no added responsibilities and innovation in applications with minimal impact are fostered.

Artificial intelligence tools that are utilized in education or vocational education and affect the availability of education or the performance are considered high-risk within the scope of the Act. Examples include:

  • Admissions and Grading: Artificial intelligence-based tools used in university admissions or automated grading (e.g., Pearson AI-based assessment platforms) should be fair, transparent and have human review to eliminate biases, as has happened in the case of the UK 2020 A-level grading algorithm fiasco. Providers would be required to perform conformity checking, risk mitigation documentation, and enlisting in a European database.

  • Personalized Learning Platforms: Adaptive learning platforms such as Squirrel AI or Century Tech, which place content specific to students and their data, should meet high data ownership and accuracy principles not to produce discriminating results. Furthermore, ensuring human oversight in automated grading or admissions processes requires significant investment in training and infrastructure.

Britain falls outside the scope of the EU AI Act as a member of a non-EU member state following Brexit. Nevertheless, its effects on their EdTech industry (which is a prominent part of the online education scene in the UK) are already huge because of cross-border business, regulatory differences, and working possibilities.

In contrast, the EU AI Act’s prescriptive rules set a global benchmark, potentially pressuring UK firms to align voluntarily to compete in the EU or enhance credibility.

This divergence creates challenges and opportunities:

  • Challenges: UK EdTech firms face dual compliance burdens, navigating lighter UK rules and stricter EU standards. For instance, an AI grading tool compliant in the UK may need additional transparency measures for EU markets.

  • Opportunities: The UK’s flexible approach attracts innovation, with London hosting numerous EdTech startups. However, adopting EU standards could streamline access to the EU market, fostering trust among European users.

UK-EU Collaboration

UK-EU agreement announced in May 2025 facilitates AI collaboration, granting UK researchers and EdTech startups access to Europe’s AI Factories (supercomputing hubs). This supports the development of AI-driven educational tools, such as virtual labs or simulations, but requires compliance with EU standards for joint projects. Additionally, the UK’s signing of the Council of Europe’s AI Convention on September 5, 2024, aligns it with EU values on human rights and rule-of-law in AI, indirectly supporting educational applications.

Education-Specific Implications

The EU AI Act’s focus on high-risk educational AI directly affects UK firms operating in Europe. For example:

  • Bias Mitigation: AI tools like Century Tech’s adaptive learning must ensure non-discriminatory outcomes, requiring robust testing to comply with EU standards.

  • Transparency: UK platforms offering chatbots or virtual tutors in the EU must disclose AI usage, aligning with the Act’s limited-risk rules.

  • Market Competitiveness: As the EU AI Act becomes a global standard, UK firms adopting its requirements may gain a competitive edge, especially in markets valuing ethical AI.

The UK’s Ofsted guidance on AI in schools, issued recently, reflects awareness of these issues but lacks the EU’s comprehensive framework. This regulatory gap could disadvantage UK firms unless they proactively align with EU standards.

Broader Implications

The EU AI Act’s global influence could reshape the EdTech landscape. As Europe leads in AI governance, the UK risks falling behind if it fails to adopt comparable standards. However, the UK’s participation in AI Factories and the Council of Europe’s AI Convention offers pathways for collaboration, potentially harmonizing EdTech innovation.
